제3조 (약관의 효력 및 변경)

  1. 이 약관은 서비스 화면에 게시하거나 기타 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
  2. 회사는 합리적인 사유가 있는 경우 관련 법령에 위배되지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 적용일자 및 변경사유를 명시하여 최소 7일 전에 공지합니다.

제4조 (서비스의 제공)

  1. NOVA는 ROM 파일을 제공, 호스팅, 배포하지 않습니다.
  2. 이용자는 본인이 합법적으로 소유한 게임의 ROM 파일만 서비스에서 사용해야 합니다.
  3. 저작권이 있는 ROM 파일의 불법 다운로드, 배포, 공유에 대한 모든 법적 책임은 이용자에게 있습니다.
  4. 회사는 불법 ROM의 사용을 조장하거나 방조하지 않습니다.
  5. 회사는 이용자의 ROM 파일 내용에 대해 어떠한 책임도 지지 않습니다.

제6조 (NOVA Premium 구독)

  1. NOVA Premium는 유료 구독 서비스로, 다음의 추가 기능을 제공합니다:
    • 무제한 게임 라이브러리
    • 무제한 Save State 슬롯
    • 치트 코드 기능
    • 전체 플레이 통계
    • 광고 제거
  2. 구독 플랜은 월간, 3개월, 6개월 단위로 제공되며, 각 플랜의 가격은 Apple App Store 또는 Google Play Store의 가격 정책에 따릅니다.
  3. 구독은 이용자가 직접 해지하지 않는 한 자동 갱신됩니다.
  4. 구독 결제 및 환불은 Apple App Store 또는 Google Play Store의 정책을 따릅니다.
  5. 회사는 구독 플랜의 가격 및 내용을 변경할 수 있으며, 변경 시 사전에 공지합니다.

제7조 (이용자의 의무)

  1. 이용자는 다음 행위를 하여서는 안 됩니다:
    • 저작권이 있는 ROM 파일의 불법 다운로드, 배포, 공유
    • 서비스의 리버스 엔지니어링, 디컴파일, 디스어셈블
    • 서비스를 이용한 불법 행위
    • 타인의 지적재산권 침해
    • 서비스의 정상적인 운영을 방해하는 행위

제8조 (회사의 면책)

  1. 회사는 에뮬레이션 소프트웨어를 제공할 뿐이며, ROM 파일의 합법성에 대한 판단 또는 보증을 하지 않습니다.
  2. 회사는 이용자 간 또는 이용자와 제3자 간의 분쟁에 대해 관여하지 않으며 이에 대한 책임을 지지 않습니다.
  3. 천재지변, 시스템 장애 등 불가항력으로 인한 서비스 중단에 대해 회사는 책임을 지지 않습니다.
  4. 이용자가 서비스를 통해 저장한 데이터(세이브 데이터, ROM 파일 등)의 손실에 대해 회사는 책임을 지지 않습니다.

제9조 (지적재산권)

  1. 서비스에 포함된 소프트웨어, 디자인, 텍스트, 그래픽 등 회사가 작성한 저작물에 대한 지적재산권은 회사에 귀속됩니다.
  2. 서비스는 오픈소스 라이브러리(libretro 코어 등)를 포함하며, 해당 라이브러리는 각각의 라이선스 조건을 따릅니다.

제10조 (서비스 변경 및 종료)

  1. 회사는 서비스의 전부 또는 일부를 변경하거나 종료할 수 있으며, 이 경우 30일 전에 공지합니다.
  2. 무료 서비스의 변경 또는 종료에 대해 회사는 별도의 보상을 하지 않습니다.

4. ROM Files and Copyright

IMPORTANT — PLEASE READ CAREFULLY:

  1. NOVA does not provide, host, or distribute ROM files.
  2. You must only use ROM files of games that you legally own.
  3. You are solely responsible for the legality of any ROM files you use with the Service.
  4. The illegal downloading, distribution, or sharing of copyrighted ROM files is strictly the user's responsibility.
  5. NOVA does not encourage or facilitate the use of illegal ROMs.
  6. The legality of emulation software has been affirmed by court precedent, but this does not extend to unauthorized ROM distribution.

5. NOVA Premium Subscription

  1. NOVA Premium is a premium subscription that provides additional features including:
    • Unlimited game library
    • Unlimited Save State slots
    • Cheat code support
    • Full play statistics
    • Ad-free experience
  2. Subscription plans are available in monthly, 3-month, and 6-month intervals. Prices are determined by Apple App Store and Google Play Store pricing policies.
  3. Subscriptions automatically renew unless cancelled by the user before the renewal date.
  4. Payment and refunds are processed through the Apple App Store or Google Play Store and are subject to their respective policies:

6. User Obligations

You agree not to:

7. Disclaimer of Warranties

  1. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

  3. The Company does not guarantee uninterrupted or error-free operation of the Service.
  4. The Company is not responsible for the loss of any data stored through the Service (save data, ROM files, etc.).

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

9. Intellectual Property

  1. All intellectual property rights in the Service (software, design, text, graphics, etc.) created by the Company belong to the Company.

8. การจำกัดความรับผิด

Diese Nutzungsbedingungen („Bedingungen") regeln Ihre Nutzung der NOVA-Anwendung („Dienst"), die von ideatag studio („Unternehmen", „wir", „uns") bereitgestellt wird. Durch das Herunterladen, Installieren oder Nutzen von NOVA erklären Sie sich mit diesen Bedingungen einverstanden.

2. Definitionen

  • Dienst: Die NOVA Retro-Spiele-Emulator-Anwendung und alle zugehörigen Dienste.
  • Nutzer: Jede Person, die den Dienst gemäß diesen Bedingungen nutzt.
  • ROM-Datei: Eine digitale Kopie von Spielkassettendaten.
  • NOVA Premium: Der Premium-Abonnementdienst mit zusätzlichen Funktionen.

3. Dienstbeschreibung

NOVA ist eine Retro-Spiele-Emulator-Anwendung, die es Nutzern ermöglicht, ROM-Dateien, die sie rechtmäßig besitzen, auf ihren mobilen Geräten auszuführen. Der Dienst umfasst:

  • Emulation von Retro-Spielkonsolen (GBA, GB, GBC, NES, N64, NDS, PSX, PSP, PCE, Lynx, NGP/NGPC)
  • Speichern und Laden von Spielständen (Save State, SRAM)
  • Verwaltung der Spielebibliothek
  • Spielstatistiken und -verlauf
  • Virtuelles Gamepad und Controller-Unterstützung

4. ROM-Dateien und Urheberrecht

WICHTIG — BITTE SORGFÄLTIG LESEN:

  1. NOVA stellt keine ROM-Dateien bereit, hostet sie nicht und verbreitet sie nicht.
  2. Sie dürfen nur ROM-Dateien von Spielen verwenden, die Sie rechtmäßig besitzen.
  3. Sie sind allein verantwortlich für die Rechtmäßigkeit aller ROM-Dateien, die Sie mit dem Dienst verwenden.
  4. Das illegale Herunterladen, Verbreiten oder Teilen urheberrechtlich geschützter ROM-Dateien liegt ausschließlich in der Verantwortung des Nutzers.
  5. NOVA fördert oder erleichtert nicht die Verwendung illegaler ROMs.
  6. Die Rechtmäßigkeit von Emulationssoftware wurde durch Gerichtsentscheidungen bestätigt, dies erstreckt sich jedoch nicht auf die unbefugte Verbreitung von ROMs.

5. NOVA Premium-Abonnement

  1. NOVA Premium ist ein Premium-Abonnement mit zusätzlichen Funktionen, darunter:
    • Unbegrenzte Spielebibliothek
    • Unbegrenzte Save State-Slots
    • Cheat-Code-Unterstützung
    • Vollständige Spielstatistiken
    • Werbefreies Erlebnis
  2. Abonnementpläne sind in monatlichen, 3-monatigen und 6-monatigen Intervallen verfügbar. Die Preise richten sich nach den Preisrichtlinien des Apple App Store und des Google Play Store.
  3. Abonnements werden automatisch verlängert, sofern der Nutzer nicht vor dem Verlängerungsdatum kündigt.
  4. Zahlungen und Rückerstattungen werden über den Apple App Store oder Google Play Store abgewickelt und unterliegen deren jeweiligen Richtlinien:

6. Pflichten des Nutzers

Sie verpflichten sich, Folgendes zu unterlassen:

  • Illegales Herunterladen, Verbreiten oder Teilen urheberrechtlich geschützter ROM-Dateien
  • Reverse Engineering, Dekompilierung oder Demontage des Dienstes
  • Nutzung des Dienstes für illegale Zwecke
  • Verletzung der geistigen Eigentumsrechte anderer
  • Störung des normalen Betriebs des Dienstes

7. Gewährleistungsausschluss

  1. Der Dienst wird „WIE BESEHEN" und „WIE VERFÜGBAR" ohne jegliche Gewährleistung, weder ausdrücklich noch stillschweigend, bereitgestellt.
  2. Das Unternehmen stellt lediglich Emulationssoftware bereit und trifft keine Beurteilungen oder Garantien hinsichtlich der Rechtmäßigkeit von ROM-Dateien.
  3. Das Unternehmen garantiert keinen ununterbrochenen oder fehlerfreien Betrieb des Dienstes.
  4. Das Unternehmen ist nicht verantwortlich für den Verlust von über den Dienst gespeicherten Daten (Speicherdaten, ROM-Dateien usw.).

8. Haftungsbeschränkung

Im maximal gesetzlich zulässigen Umfang haftet das Unternehmen nicht für indirekte, zufällige, besondere, Folge- oder Strafschäden, die aus oder im Zusammenhang mit Ihrer Nutzung des Dienstes entstehen.

9. Geistiges Eigentum

  1. Alle Rechte an geistigem Eigentum am Dienst (Software, Design, Text, Grafiken usw.), die vom Unternehmen erstellt wurden, gehören dem Unternehmen.
  2. Der Dienst enthält Open-Source-Bibliotheken (libretro Cores usw.), die den jeweiligen Lizenzbedingungen unterliegen.

10. Änderung und Beendigung

  1. Das Unternehmen kann den Dienst ganz oder teilweise mit einer Frist von 30 Tagen ändern oder beenden.
  2. Für Änderungen oder die Beendigung kostenloser Dienste wird keine Entschädigung gewährt.

11. Änderungen der Bedingungen

Das Unternehmen kann diese Bedingungen von Zeit zu Zeit aktualisieren. Wir werden Sie über wesentliche Änderungen informieren, indem wir die aktualisierten Bedingungen mindestens 7 Tage vor ihrem Inkrafttreten im Dienst veröffentlichen.

  6. 模擬軟體的合法性已由法院判例確認，但這不適用於未經授權的 ROM 散布。

5. NOVA Premium 訂閱

  1. NOVA Premium 是提供額外功能的高級訂閱，包括：

9. 智慧財產權

  1. 服務中由公司建立的所有智慧財產權（軟體、設計、文字、圖形等）歸公司所有。

10. 修改與終止
